Commission Info/TOS

Thank you for your interest in my commission page. Please read through the TOS below before you send a commission request.

By sending a digital art commission request to ChessCat, you agree that you understand and accept these Terms of Service. You acknowledge that this is a digital product, and that no physical items will be shipped to you as a result of this commission.Commissions must be paid in full before the commission will be started. As the artist involved in these commissions, I (ChessCat) own the copyright over the art pieces I create; and through the commission process, grant permission to the commissioner to do as they please with their commissioned art piece as long as it follows the agreed upon terms as stated in the commission request, or as agreed in conversations made after completion (personal, content, and commercial use). These Terms of Service apply to any and all future commissions. You may NOT use any of my artwork for the purpose of training AI or submit it into a generative AI program or any other similar programs. Any clients using generative AI with my work will be blacklisted from commissions, and I may revoke their permission to use my artwork for any use.Refunds will only be guaranteed before the commission has started. If a commission’s completion progress is halted early, a partial refund will be given as best determined by me on the stage of completion.I (ChessCat) have the right to refuse any commission request for any reason. I also have the right to stop the progress of a commission for any reason. In the event the progression of a project is terminated before it's originally planned completion, the commission will be sent to the client in whatever stage of progress it is in at the time of the commission’s end.Payments for commissions will be done primarily through ChessCat's Ko-Fi page. Personal Use
(Profile Pictures, Channel Banners, Engagement Posts) will not require any additional payment, while Commercial Use (Prints, Subscription Rewards, Merch, anything being sold for currency) will only be allowed after an additional payment is paid in the commission request (or if declared after the commission's completion, a fee that will be decided by myself (ChessCat)). For Content Use (Video Thumbnails, Independent Promotional Piece, Streaming Use), please message me about it first.
Communication will be done through the Ko-Fi chat, X (formerly known as Twitter) direct messages, or Instagram direct messages. Please be sure to include your preferred method of contact when creating a request. Attempting to contact me through any other social media or other means will not guarantee that I will see your message. All commissions will have a simple rendering style by default. Commissions may have an option to be requested to have a more complex style of rendering for an additional cost. Commissions can also have a simple color/shape background at the request of the commissioner for no addictional cost. Complex backgrounds (rooms, environments) are available at an additional cost.If I am unsure about the quality I can provide on a commission, I will bring it to the attention of the commissioner and confirm that they want to move forward with the project.Once a sketch of the commission has been created, a copy will be sent to the commissioner to confirm details are correct. Only a total of 3 large changes (requesting a different pose, angle, outfit, or hairstyle, etc.) will be allowed. If the commissioner has not responded after two business days since the original sketch was sent, the commission will move on to the next stage as if the sketch was approved. Once a commission has progressed past the sketch phase, only minor adjustments will be allowed to ensure the commission is finished in a timely manner. Any additional large changes, or large changes done after the agreed sketch will only be made when an additional fee has been paid (additional large changes require a lot of additional work to include and will make Chess cry if they have to change something after already making it look pretty). Please allow at least 21 business days (about 3 weeks) for your commission to be completed. If additional time is needed, I will let the commissioner know before the last day. I ask you to please be patient with me, and I will do my best to stay within the agreed timeframe. If a commission has a deadline, please include it in your request, and I will inform you if I think I will be able to have the artwork completed by then.If you would like to post the commission on your own social media page, please be sure to credit me (ChessCat) as the artist. Any artwork that I create must be credited towards me as the artist (Tagging me, "@ChessCat," listing my name clearly in the post, "🎨: ChessCat," or linking my profiles are examples of valid forms of crediting me. "Credits to the artist" is an example of NOT a valid form of credit). I may stream myself creating the commission on my streaming channels. If you would not like me to stream myself creating the artwork, please tell me in your commission request. It is the commissioner's responsibility to have access to a copy of their finished, commissioned artwork after the finalized commission has been sent to the commissioner. Please be sure to back up all commissions you receive, as an original copy will not always be available after the commission is finished.I have the right to change these Terms of Service at any point. Failure to adhere to these terms will result in permanent blacklisting and/or legal action. For any questions about a commission or these terms of service, please send them through my social media pages.
